集体管理组织与著作权保护困境

摘　　要：著作权集体管理目前是行使著作权的重要方式。我国现有五家著作权集体管理组织。我国的著作权集体管理目前存在管理范围重叠、收费方式以及著作权使用费分配存有争议等问题。鉴于著作权集体管理比著作权人自行授权及著作权代理在理论上更有优势,所以对著作权集体管理进行完善很有必要,应完善许可使用费收取和分配方式,制定合理的管理费提取标准,并引入反垄断法对著作权集体管理组织进行规制。A collective administration is one of the most important means of regulating copyrights. There are five copyright collective administration organizations in China today. The problems which copyright collective administration organizations are facing include the following aspects ： （a） the scope of administration ore charging method is controversial ; and （c） the distribution of the copyright royalties is disputable. perfect the system of collective administrations by ways of nerfecting the means of licensing and distributing royalties, regulating reasonable standards of royalties＇ extraction, and introducing the anti-trust regulations in the field.
