摘　　要：中国传统的"无讼"思想有其适应当时社会的和谐价值:在思想层面表现为通过无讼的理念对传统道德的实现;在制度层面体现为通过限制诉讼、调解手段平息诉讼、解决争端;在社会民众层面则达到了人们贵和求安的社会秩序追求;在整体社会效果层面则有效地集中了司法资源打击刑事犯罪。"无讼"思想对社会主义和谐社会建设具有重要的启示和借鉴意义。China＇s traditional thought of non-litigation is of harmonious value for the society at that time： realizing the traditional morality through the concept of non-litigation,bring litigation to an end and resolving disputes through restricting litigation and means of mediation,achieving people＇s pursuit for secure social order,and effectively employing judicial resources to strike criminal offences.The thought of non-litigation is of great enlightenment and meaning of reference for the construction of socialist harmonious society.
