摘　　要：低碳发展与专利制度密切相关。实现低碳发展,需要专利制度促进低碳技术创新及其应用,但我国专利制度在适应低碳发展需求方面存在不足之处。在低碳发展背景下,专利制度的价值取向从个体权利为中心转向个体利益与公共利益并重。基于低碳发展导向,需要对专利制度在专利取得制度、审查标准、运用制度、对外交流制度以及其他制度方面进行变革,以促进低碳发展。The low-carbon development is closely involved in patent system,which will generate needs for the patent system and its value orientation will turn to the public interests.The patent policy of China is based on the traditional pattern of economic development,which displayed unsuitability with the low-carbon economy.In order to develop the low-carbon economy,the patent system of China must be reformed in aquiration system,examination criterion,application system,foreign communion system and others according to the needs of the low-carbon technology innovation.
