公共政策合法性的民意表达:网络公共舆论与协商民主

摘　　要：民意作为公共政策合法性的基础与来源,它在公共政策制定、执行中发挥着重要的作用。公共舆论和协商民主作为公共政策合法性的主流民意表达的两种方式,也是公共政策获得民众认同的两种重要途径。网络公共舆论作为公民话语权的一种表达形态,有效地弥补了传统媒体反映民意不足的缺陷,为公共决策提供了新的平台。协商民主是一种具有巨大潜能的民主治理形式,在本质上以公共利益为取向,主张通过对话实现共识,进而做出得到普遍认同的决策。The public opinion that takes as foundation and the origin of the community policy legitimacy plays the vital role in formulating and carrying out the community policy.Public opinion and deliberative democracy are not only two expression ways of the mainstream public opinion about the legitimacy of public policy,but also are two important ways of earning the public＇s recognition of public policy.The network public opinion which takes as a kind of expression shape of the citizen words power made up the defects of the traditional media reflecting the public opinion effectively.It has provided the new platform for the public decision-making.The consultative democracy takes as one kind of huge potential democracy governing form,it takes the public interest as the orientation essentially,it advocates realizing the mutual recognition through the dialogs,and then obtains the general accepting decision-making.
