摘 要:借《中华人民共和国侵权责任法》2010年7月1日施行以及修改后的《中华人民共和国国家赔偿法》于2010年12月1日实施之契机,重新审视不动产登记案件审理中的重点问题。登记行为的性质系具体行政行为中的确认行为。但是因为登记错误致使的国家赔偿系一种民事责任,属于民事侵权损害赔偿之特则。权利人除了损害赔偿救济方式外,还享有借助行政诉讼程序获得撤销登记、恢复登记等救济方式。这些需要人民法院的行政审判与民事审判有所分工且相互配合,以使不动产登记制度真正能维护交易安全,在公民物权受到侵害时使之获得充分之救济。After The Torts Law of the People's Republic of China was implemented on July 1,2010 and the Law of the People's Republic of China on State Compensation Amended was enacted on December 1,2010,it is important for us to reconsider the Problems of Trial of Realty Registering Cases.It is believed in this paper that the process of realty registering is an administrative act which affirms a civil right.But the state compensation liability aroused by the wrongful registering act is a civil tort liability.Besides the relief above,the subject also enjoy the right to apply to cancel the wrongful register and resume the right one through the administrative procedure.Thus the civil and the administrative departments in courts should cooperate on the same purpose of maintenance of the exchange order in order to protect the rights and interests of citizens and legal persons.
