后经济危机时代对法律制度模式的思考

摘　　要：2008年,一场源于美国的经济危机席卷了世界。经济学界的声音成为了此次事件的主流声音,而法学界对此却少有关注。实际上当前的法律制度模式在此次经济危机中扮演了不可或缺的角色,而这种角色又是与这种法律制度模式本身的特点分不开的。进一步看,这种法律制度模式所维续的人类发展的原动力以及由此带来的世界层面上的困境是产生此次经济危机的深层原因。In 2008, an economic depression which originates from America sweeps the whole world. The voice from the circle of economics is dominant. However, the voice from the circle of law is quite inadequate. In fact, the present legal system model plays an inevitable role in generation of this economic depression, and its role is closely related with one feature of the legal system model. Further more, the original driving power of human being＇s development that the legal system model preserves is a further root, and it results in global confusion and dilemma that the legal system model fails to solve.
