摘　　要：法律与制度的变革,既改变法律与制度的内容,改变作为调整社会关系、维持社会秩序基本标准的规范,也不同程度地影响引导社会发展、构成社会评价核心依据的主流价值观。法律与制度自身内容的特殊性,对于主流价值观的影响呈现出程度上的不同,因而表现出法律与制度变革的不同价值效应。近代中国法律与制度变革经历了艰难、复杂的历程。不同的法律与制度,在其从传统向近代转型过程中,也展示出对社会主流价值观产生不同影响的价值效应;同时,由于变革中的法律与制度的价值效应的不同,又直接影响法律与制度变革的过程、途径和效果。The reform of law and system, that is, changing the contents of law and system and changing the norms functioning as the basic standards regulating social relationships and maintaining social order, to different extents, influences the mainstream values leading social development and composing the core basis of social evaluation. As the specific characteristics of the contents of law and system per se influence the mainstream values in different ways, different value effect of law and system reform is exhibited. The reform of law and system in modern China experienced a difficult and complicated course. Different law and system also show the value effect of having various influences on social mainstream values in the process of transiting from traditional model to modern model; moreover, the different effect value of the law and system in reform directly works upon the progress, ways and effects of law and system.
