摘 要:在民营化思潮及服务型政府建设的双重影响下,政府业务委托民间办理渐成我国公共行政改革的重要方向,本文从行政法视角对委托外包的政府业务进行了梳理,认为我国外包的政府业务可以划分为政府行政性业务、政府事业性业务和政府经营性业务,三类不同的政府业务委外具有各自不同的法律属性,应当分别规范:政府行政性业务委外在性质上属于行政委托,由行政委托制度规范,政府事业性业务委外可纳入政府采购的范围,由政府采购法等法律调整,而政府经营性业务委外为政府特许经营,应适用行政许可法及规范政府特许经营方面的特别法。On the dual influence of the trend of thought of privatization and constructing the service type government, the government's contracting its affairs out to the civil becomes a important direction in our country's public administration reform. The article arranges the government affairs contracting out on the administrative angle and considers that the government affairs contracting out in our country can be divined into three types: the government administrative affairs, the public utilities and the government engagement affairs; and they have different legal nature, so they should be standardized distinguishingly. The government administrative affairs contracting out should be considered as administrative entrusting in the nature and be standardized by the administrative entrusting systems. The public utilities affairs contracting out should be confined into government procurement and be standardized by the government procurement law. The government engagement affairs contracting out is a kind of government franchising and should be standardized by the administrative permission law and the specific laws which standardize government franchising.
