摘 要:再谈判是公私合营(public-private partnership,PPP)项目实施过程中的一个重要问题,再谈判的高发会导致资源的浪费以及管理效率的降低。因此,研究再谈判问题可以有效减少再谈判的发生,从而提高我国PPP项目的经营绩效。近30年,拉美国家PPP项目再谈判的众多案例为我国提供了很好的借鉴意义。从PPP项目国际经验出发,结合我国实际,分析找出了PPP项目再谈判的关键影响因素,提出了进一步完善PPP立法、改进合同设计、规范竞争性招标、加强监管以及明确相应惩罚制度等应对措施,为我国公私双方PPP管理工作提供理论依据。Renegotiation is an important issue of public-private partnership (PPP). The high incidence of renegotiation will lead to resources waste and management efficiency reduction. Therefore, it is nessary to study the renegotiation issue to reduce incidence of renegotiation and enhance the operating performance of China's PPP projects. The rich renegotiation in PPP projects in the region of Latin American countries in the past 30 years proride great reference for us. On the basis of international experience, combining with China's reality, we find the key factors of renegotiation, and then put forward the measures of improving the PPP legislation, such asimproving the design of contract, standardizing competitive bidding and enhancing monitoring and so on, to deal with renegotiations in China's PPP projects.
