摘　　要：代履行是一种比较广泛使用的间接强制执行方法,但目前在理论界与实践中并未形成统一的认识。只有没有利害关系的第三人代为履行才是真正意义上的代履行,在紧急情况下的行政机关代为履行则属于直接强制执行。从公私合作的背景来看,第三人与行政机关之间是民事合同关系。代履行的实质是公与私之间的优势互补,充分发挥了行政机关、社会组织、企业在社会治理中各自的优势。Replace the fulfillment is one kind of quite widespread the indirect method use enforces, but present has not formed the unified understanding in the theorists and the practice. Then does not have the stake third person to replace the fulfillment is replace the fulfillment in the true sense, replaces the fulfillment in emergency case＇ s administrative organ to belong enforces directly. Looking from the public-private partnershipss background, Between third person and the administrative organ is the civil relationship. Replace the fulfillment＇ s essence is public and the private between survival of the fittest, has displayed the administrative organ, the social organization, the enterprise fully, in the society governs the respective superiority
