摘　　要：高校依法对学生享有自主管理权,对促进高校教育事业的发展是必要的,且已经发挥了积极的作用,但这种自主管理权的行使不是绝对随意性的,否则就会侵害学生的基本权利,不断引发高校与学生之间的纠纷.因此,如何实现高校学生管理的行政法治,即如何实现高校内部规章制定的法治化,高校对学生具体管理行为实体和程序的法治化,是推进高校教育事业发展和维护学生合法权益的关键.Universities and colleges have the right to govern the students by law, which is necessary to promote higher education development and has played positive role ia the development. However, the right to govern is not arbitrary, or students basic rights will be infringed and lead to lawsuits between school and student. Therefore, it is very important to realize the legalization of governing students in universities and colleges, including the legalization of internal rules and regulations in universities and colleges and the entity and process of governing students, which is the key to promote higher education development and safeguard students lawful rights.
