摘 要:随着2007年9月1日《铁路交通事故应急救援和调查处理条例》的施行,铁路运输企业对因铁路交通事故造成铁路旅客人身损害的赔偿责任限额已由原来的4万元人民币提高到15万元人民币。但由于该条例仅调整因铁路交通事故造成的旅客人身损害案件,司法实践中大量的非铁路交通事故造成的旅客人身损害赔偿案件则不属于其调整的范围,且又将《铁路旅客运输损害赔偿规定》予以废止,导致实践中大量此类案件的赔偿标准如何确定存在较大的争议。针对赔偿争议予以探讨,以期裨益于司法实践和立法的完善。Because 《Regulation for Emergency Rescue and Investigation Deal of Railway Transport Accident》was taken effect on Sep. 1, 2007, the quota which railway transport enterprises compensate to railway passengers whose injuring due to railway transportation accidents has increased from 40 000 yuan to 150 000 yuan. The regulation only applies to cases of passenger's body injuring due to railway transport accidents, doesn't include cases of passenger's body injuring due to non-railway transport accidents, at the same time 《Provision of Compensation for Railway Passengers Transport Damage》was abolished, thus there are many disputes about determining the compensation standard in practice. Through discussing the compensation disputes, hope to help justice practice and perfect the law.
