美俄卫星相撞事件中的国际法问题探析

摘　　要：结合美俄卫星相撞事件,对外层空间法中的损害求偿、空间碎片与外空安全规则这3个问题进行了分析。认为,应当将"责任公约"关于过错责任的规定应当为绝对责任所取代,将空间碎片造成的外空环境污染界定为一种独立的法律责任,并应在国际范围内制定有关外空安全利用的规则,使外空的安全利用成为与和平利用相并列的国际外空法原则。This article gives an analysis on the legal issues related to the satellite collision event between the U.S.A.and Russia,including claim of compensation,space debris and outer space safety rules.The author considers that the fault liability provided by the Liability Convention shall be replaced by the absolute liability,outer space environment pollution caused by space debris shall be defined as an independent type of legal liability and outer space safety rules shall be established within the international community,making safe exploration of outer space a fundamental principle,like peaceful use,of international outer space law.
