运动员商事人格权的法律风险研究

摘　　要：目前我国运动员商事人格权由于受主客观因素的影响,在其行使过程中遇到各种风险,如违反平等权、违反公平权、违反契约、违反社会公德等带来的法律风险,由于缺少规避风险的途径和措施,造成合法利益难以获得,甚至承担赔偿责任。学术界虽已意识到这个问题,但研究成果较少。通过文献研究与现实调查相结合的方法对这一问题进行客观分析和研究,并有针对性的提出建议和措施,为保护运动员商事人格权提供借鉴。At present,the athletes＇ trading personality power in our country is affected by physical factors,and meets all kinds of risk in the process of operation,and it can bing the legal risk,such as,counter-equality,counter-fair,counter-agreement,counter-society ethics and so on.Because of being short of the way and the measures of the evading risk,this can lead to the legal advantage difficult to be received,and even undertakes the liability of compensation.The academic circle has realized this question,but the research results are few.The issue is objectively analysed and studied through combining the literature search with the reality investigation,proposed the suggestion and the measure in the light of the issue,and and possess the reference for protecting the athletes＇ trading personality power.
