摘　　要：宪政是法治的高级形式。宪政是以宪法为前提,民主是宪政的基础,法治是宪政的载体,人权是宪政的目的。宪政包含民主、法治和人权三个基本要素,宪政民主就是以宪政主义为根本的民主制度,宪政决定法治,宪政和法治必须是以良法为前提,良法之关键在于宪法的至上性。Constitutionalism is the highest form of the rule of law.The Constitution is the premise of constitutionalism,democracy is the basis,the rule of law is carrier,and human rights are goal.Constitutionalism includes three fundamental facts-democracy,the rule of law and human rights.Constitutional democracy is the democracy system based on constitutionalism;constitutionalism can decide the rule of law,the premise of constitutionalism and the rule of law must be the good law,and the key of good law is the Constitution authority.
