审查起诉阶段检察官心证的合理运用与保障机制

摘　　要：传统意义上的自由心证仅指法官对判断案件证据的内心确信过程,而对检察官在审查起诉阶段的主观心理活动,法学界却没有给予其如同对法官自由心证那样的关注。事实上在审查起诉工作中,检察官同样有依靠证据内心确信的过程,文章对检察官合理运用自由心证作了分析,并提出了我国检察官自由心证保障机制的完善措施。The traditional free evaluation of the evidence is the inner ensureance proceeds as the judge estimates the evidence.The normal action of procuratorate officer in the review and prosecution stage has not been concerned.In fact,procuratorate officers have the same inner ensureance proceeds in the stage of review and prosecution.The article studies on the rational use of free evaluation of the evidence,and points out the improvement countermeasures.
