管窥秦汉法律的家族特征——兼评《秦汉家族犯罪研究》

摘　　要：贾丽英博士的专著《秦汉家族犯罪研究》是研究秦汉家族犯罪问题的基础之作。著述对家族、家族犯罪等概念进行了科学的定义与界定,并将秦汉法律条文与具体案例相结合,对秦汉家族犯罪的类型逐一进行了分析和总结,在此基础上分析了秦汉家族犯罪的演变、特点、影响以及政府所采取的控制措施。进而说明秦汉法律本身就蕴含了家族主义和等级观念因素,而并非法律儒家化的结果。In the monograph named The Research on the Family＇ s Crimes in Chin and Han Dynasty, Dr. Jia Liying defined the concepts of the family, the family＇ s crimes and so on. With the Chin and Han Laws and speeifie cases, she also summarized and analyzed all kinds of the family＇ s crimes in Chin and Han Dynasty. Then she analyzed the evolution, characteristic and influence of the family＇ s crimes and the measures that the government had taken. The laws in Chin and Han Dynasty had contained the concepts of the family and estate, not the result of the Confucianism＇ s influence.
