论村民自治权力制约机制的构建

摘　　要：对村民自治权力进行必要的监督与制约,是保证村民自治权力运行不偏离社会主义新农村建设和村庄公共利益轨道的基本途径。现行《村民委员会组织法》条文规定较为模糊,该制度的实际运行效果与文本设计有所偏离。应当以村民自治内涵为基础,以权力划分与制衡为思路,构建"村权三分、支部监督、村财共审、规范公开"的村民自治权力制约机制。The power supervision and restriction in villagers＇ autonomy is the basic way to ensure villagers＇ autonomous power in the right direction of building a new socialist countryside and the public interest of a village.As the stipulations of the current Villagers Committee Organization Law are vague in prescription,its actual running result is unsatisfactory,failing to be accord with the original design of the document.Accordingly it is held that taking the contents of villagers＇ autonomy as the foundation,separation and restriction of power as the approach,a power restriction mechanism in villagers＇ autonomy is developed by ＂separation of village power,supervision of party branch,joint audit of village finance,standardization and publicity＂.
