摘　　要：我国《侵权责任法》第55条首次在法律层面规定了患者知情权原则,具有重要意义。但是,在司法实践中如何适用该条规定存在一定困难。从患者知情权与同意权的区分、患者知情权的范围、医疗机构履行告知义务的标准及医疗机构的免责条件等方面展开分析。Tort Liability Law provides the informed consent fight of patients in the basic aspect of civil law for the first time. But in its actual operation, there are some difficulties. Therefore, this paper discusses these items： separate the patients fight to information and consent, the range of the fight, the standards of medical institutions to carry out the duty of inform and the exemption of the doctors.
