摘  要:我国的行政许可依其法律性质、适用条件的不同,可以划分为行政特许与普通许可两大类,行政特许的本质是分配稀缺资源,出让国家所有的财产权,而普通许可的本质是解除法律禁止,恢复当事人的行为自由。区分行政特许与普通许可一方面是为了有效保护当事人因特许取得的财产权益,另一方面防止行政机关将本属于普通许可的事项纳入特许的范围进行收费,从而将许可演变成为政府角逐经济利益的手段和工具。According to its legal nature and applicable factors, administrative permit in our country can be divided into administrative franchise and common administrative permit. The nature of administrative franchise is to distribute the rare resources and to sell the country' s right of property. The nature of common administrative permit is to relieve the legal prohibition and to resume the other party's behavior freedom. To differentiate administrative franchise and common administrative permit on one side is to protect the other party' s right of property getting from franchising, and on the other side is to avoid administrative bodies' changing the common administrative permit items into administrative franchise items and make the administrative permit into the trick which can bring the government economic benefits.
