公有公共设施致害的国家赔偿责任研究

摘　　要：由于社会上公有公共设施致害事件频发,公有公共设施致害的法律问题引起了理论界的关注。本文主要从公有公共设施致害的归责原则、赔偿义务机关和赔偿方式三个方面,对公有公共设施致害的赔偿责任问题进行了探讨,并提出了理论方面的主张。Because of frequency of the public facilities damage events,the legal issues caused by the public facilities damage aroused a theoretical concern.This paper discussed the compensated responsibility of public facilities damage,which mainly included the principle of compensation,the organ of compensated obligation and the way of compensation.At the same time,this paper also made a theoretical proposition.
