摘　　要：在西方法律思想史的发展过程中,主要产生了自然法学、功利主义法学、分析实证主义法学以及社会法学等流派。这些理论中蕴含着对构建土地承包经营权流转制度具有指导意义的思想,诸如洛克的自由理论、奥斯汀的实在法理论和霍姆斯等的现实主义理论等,因此,从法理学的视角探讨土地承包经营权流转的理论基础十分必要。In the development of Western legal thought history,the natural law,utilitarianism law,analysis of legal positivism and social law and other schools were created.The theories contain instructive ideas for the rights of land contractual management and transfer system,such as Locke＇s liberal theory,Austin＇s positive law theory and Holmes＇ realism theory;and therefore,it is necessary to discuss theoretical basis of the land contract and the transfer of management rights from the perspective of jurisprudence.
