论网络传输服务提供者的审查与阻断义务

摘　　要：以QQ服务为代表的即时通信服务是一种网络传输服务。网络传输服务在技术手段和服务方式上具有自动性和被动性特点,这决定了传输服务不具有信息存储功能。受此影响,网络传输服务提供者既不对信息的合法性承担事先审查义务,也不承担发现违法信息的特别审查义务,在接到通知后也无须履行移除义务。为了保护社会公共安全和维护公共秩序,网络传输服务提供者应依据民法和公法规定承担一定的阻断义务。Instant Messaging represented by QQ is a kind of internet transfer services. Internet transfer service has automatic and passive attributes in respect of technological means and mode of service, which determines the lack of information storage function for transfer service. Under the influence of which, internet transfer service provider is not only free from assuming the duty of supervising the legitimacy of information beforehand, but also free from the duty of specific supervision of detecting the illegal information, even can it be exempted from the duty of removing after receiving notice. For the protection of social public security and public order, internet transfer provider should take certain responsibility of blocking and disconnecting according to the civil law and public law.
