摘　　要：遗传资源的价值在于遗传材料所蕴含的遗传功能信息而不在于遗传材料本身,过于注重遗传材料的物理属性而忽略遗传资源的信息资产价值是现有国内外遗传资源保护制度存在的明显缺陷,片面追求遗传资源保护的经济价值而忽略其生态价值和社会价值是遗传资源保护理论研究的明显误区。突破物权制度的藩篱,从无形财产的视阈深入研究遗传资源以及遗传资源权的概念、权利客体及权利主体等理论问题,把握遗传资源的财产属性,并以此为基础探寻合理的保护路径是遗传资源研究的新思路,也是本文的主旨。The value of genetic resources lies in the genetic function information contained in the genetic materials but not in the genetic materials themselves.The current domestic and foreign genetic resource protection system is obviously blemished by the over-emphasis on the physical attributes of genetic materials and their negligence of the information asset value.Misconceptions in the genetic resource protection theoretical research manifest themselves in the single-faceted pursuit of the economic value at the cost of ignoring the ecological and social value of genetic resource protection.The present paper attempted to break the barrier of real right system,make some approaches to the insight of theoretical issues such as the concepts of genetic resources,genetic resource right,and the object and subject of right,from the perspective of the intangible property,and grasp the property attribute of genetic resources.The exploration of a reasonable protection path through the above efforts is a new train of thought on the genetic resource protection research.
