摘　　要：《尚书.吕刑》作为一篇言刑专文,其所蕴涵的司法理念,初步完成了从"神判"向"人判"的历史性跨越。《吕刑》篇所体现的两造具备、察辞于差、简孚有众、惟察惟法等诉讼制度,环环相扣紧密结合,不失为诉讼活动顺利进行的基本程序保障,而其中关于哀敬折狱、惟良折狱、戒不勤、绝五过之疵等要求,更是司法者能够"中正"司法的必备素养条件。Shangshu ·Lvxing is a special article to talk about penalty. The judicial theoretic it contains initially completed a historical leap from divine judgment to human judgment. Litigation system reflected from lvxing such as plaintiff and the defendants had gone together, study the facts from the contradictory, verified the evidence from mass in legal procedure, survey and take the law as the standard were combined closely. It also had provided the basic procedural safeguards for the smooth proceedings of the lawsuit activity. Among them about the requirements such as avoid the shame of five faults, have the moral character with the feelings of commiseration to verdict the cases, used the kind-hearted people to verdict cases and abstain from lazy are the essential quality conditions for judiciary be able to judge fairly.
