流域管理立法的主要内容与体系构成

摘　　要：制约我国社会经济可持续发展的水资源紧缺等瓶颈问题,要求流域管理应体现水资源的自然特性和行政区域社会管理的和谐关系。与此相应的法律制度应重点调整跨行政区域的涉水利益关系,在法律、行政法规、规章等不同的立法层面,对流域管理体制、流域水资源管理、流域防汛抗旱减灾、河湖水域岸线管理、流域水土保持管理等主要内容进行规定,根据流域管理事项的不同影响,构建"两体两翼型"流域管理法规体系,实现主体与配套相协调。The bottleneck problems which restrained for the sustainable development of social economy in China such as the shortage of water resources required the regional management to reflect harmonious relationship between the natural property of water resources and the administrative regional social management.The corresponding law and regulation shall focus on the adjustment of interests of administrative region,and define main contents such as river management system,regional water resources management,rivers drought and flood prevention,river line management and water and soil keeping management in law,regulation and other different legislative layers.According to different influences on the regional management,＂two-system and two-branch＂ type of regional management rules were constructed to realize the coordination between the main body and the supporting body.
