摘　　要：文章以百度文库"侵权门"事件为着眼点,针对云计算技术数据传输量更庞大、用户范围更广阔、群体更复杂等新特点,及其在信息服务领域应用所产生的知识产权侵权问题,对我国现有《著作权法》及相关条例进行了分析对比,阐明了易发生侵权的原因及主要表现,提出了具有一定可行性的思路和方法,力求找到信息共享与知识产权法之间的平衡点,为云图书馆的发展提供法律依据和保障。Based on the event of Baidu library ＂tort door＂, and according to the characteristic of the new features of cloud computing data transmission more massive, user scale the broader, group more complex, etc. and infringement of intellectual property rights in its application in the information service, the paper analyzes and compares on Chinese existing the Copyright Law and related regulations , and expounds the cause and main performance of the infringement, puts forward some the feasibility the ideas and methods, and strive to find a balance between information sharing and intellectual prop- erty, and provides a legal basis and guarantee. For the develooment of the cloud library.
