流域管理立法的调整范围和目标

摘　　要：体现水资源自然特性和行政区域社会管理和谐关系的流域管理要求法律应着重调整跨行政区域的涉水利益关系,在较高的流域层面进行制度安排,以解决制约我国社会经济可持续发展的水资源紧缺等瓶颈问题。流域管理立法应当以完善的体系为目标,在流域管理体制的继承与创新相结合、流域管理制度建设的合法性与合理性相结合、流域立法资源的合理分配与充分挖潜相结合等原则指导下,构建主体与配套相协调的"两体两翼型"流域管理法规体系。Reflecting the natural characteristics of water resources management and administrative areas harmonious relationship between the social requirements,the law should focus on watershed management to adjust the wading across the administrative regions of interest,at a higher level of institutional arrangements for river basin to address the constraints of our social and economic sustainable development the water shortage and other bottlenecks.Watershed management legislation should aim to improve the system in the watershed management system combining inheritance and innovation,the legitimacy of the construction of river basin management system with a reasonable,rational allocation of resources.Watershed legislation should fully tap the potential of combining with the guidance of the principles to build the main and supporting coordination of the ＂two-body-two-wings-type＂ watershed management regulation system.
