摘　　要：刑事被害人救助是现代人权保护的重要转变,发达国家已将其作为刑事犯罪领域的重要课题。我国对刑事被害人救助的研究时间较短,国家立法层面上作为较为迟缓,但地方已经展开探索。因此,从社会维稳需求、刑事利益平衡、刑罚理念基础三方面对刑事被害人救助进行法理思考。同时,认真分析国家最新的立法动态,总结各地实践中的经验与不足,综合从救助原则、救助对象与范围、救助标准与方式、资金来源、救助机构、救助机关以及救助程序上构建我国刑事被害人救助基本体系。Economic aid to criminal victim is a transform of tries have regarded it as an important issue in the field of crime modern human rights protection. The developed coun- In China, the research on it has just begun for a short time. The national legislative mechanism slowed down the issue, but some locals have launched exploration. Based on the needs of social stability, interests balance, and the concept of penalty, this article studies the criminal victim assis- tance from legal viewpoint. At the same time, it carefully analyzes the new dynamic of national legislation, and summa- rizes the experience and shortcoming in the legal practice. It puts forward economic aid system to criminal victims should be formed based on the aid principle, relief object and scope, relief standard and mode, funding sources, aid or- ganization, aid agencies and aid program in China.
