摘　　要：从私有财产权流转入手,对城市房屋非公益拆迁的法律性质进行分析,进而讨论城市房屋非公益拆迁法律关系,并反思和检讨了非公益拆迁中的拆迁许可,提出了还原城市房屋非公益拆迁的本质、完善非公益拆迁补偿制度及诉讼救济制度、改进非公益拆迁程序等建议。Starting form the circulation of private property,this paper analyses the legal nature of non-public interest removal of urban houses,discusses its legal relation,reflects and examines the removal permit of non-public interest removal,puts forward some suggestions of knowing the nature of non-public interest removal of urban houses,perfecting its compensation system,litigation relief system and improving the procedure of non-public interest removal.
