摘　　要：环境侵权是一种特殊的民事侵权行为,环境侵权损害赔偿是环境民事责任的重要手段,环境损害赔偿具有特殊性,其实现要关注的内容是多方面的。本文试图从环境侵权损害赔偿救济体系着手,分析了中国环境侵权损害赔偿的现状,包括环境侵权损害赔偿的前提、范围、方式等问题及国外的立法实践。在此基础上着重探讨完善并构筑中国环境侵权损害赔偿体系。Environmental tort is a special kind of civil tort and environmental tort damage compensation is the important measure of environmental civil liability. Due to its particularity, the focus of environmental damage compensation is muhifold. Based on environmental tort damage compensation and remedy system, this paper analyzed the present status of Chinese environmental tort damage compensation, including the premise, scope and method etc. as well as the legislation practice abroad. The focus of this paper is placed on the improvement and construction of environmental tort damage compensation system in China.
