从“微博打拐”看我国流乞儿童隐私权的法律保护

摘　　要：网络盛传的"随手拍照解救行乞儿童"行为是对流乞儿童隐私权的侵害。强调对流乞儿童隐私权的保护,是人权的基本要求,更是基于对儿童身心健康发展的考虑。为了更好地保护流乞儿童权利,应该秉持以儿童为本的理念,确立儿童优先的宪法原则,在民事立法上明确对儿童隐私的保护,在司法实践中采用直接保护的方式,同时应加强对隐私权保护的宣传教育。The action of publishing photos to release begging children on microblog which is widely spread in network is an invasion of vagrant and begging children＇s privacy rights.Emphasizing protection of vagrant and begging children＇s privacy rights is the basic requirement of human rights,is even based on consideration of children＇s physical and mental health development.We should base on the ideas of child-centered,established constitutional principle of children first,specify children＇s privacy protection in civil legislation,adopt way of direct protection in judicial practice,and meanwhile should strengthen the propaganda and education of privacy rights protection.
