摘　　要：行政立法是当前普遍存在的现象,且得到了法律文本的支撑。回顾历史,行政立法在本源上来自议会的授权。那么行政立法的正当性基础根本应在回归到委任立法上,并同时通过事前立法控制、事中程序规制和事后司法监督等方式补强其正当性。最后为了适应现代社会多元化的发展需要,立法主体可以多元化。Administrative Legislation is a very common phenomenon currently,and it is received the support of legal texts.Looking back the law history,wo can know that the origin of the Administrative Legislation is authorized by the Legislative assembly.So the legitimacy of the Administrative Legislation should be returned back Delegated legislation,while with the help by legislative control,procedure control and Judicial Review.Finally,to meet the needs of Pluralistic society,the Legislation bodies should diversify.
