摘　　要：《侵权责任法》明确了医疗损害责任,对医疗机构的诊疗活动将产生深远的影响。本文阐述了侵权责任法与相关法律法规的关系、提出损害范围、鉴定性质及机构选择等尚待进一步明确和完善的条款及其新变化,提出了侵权责任法实施后医疗机构在医疗实践中应注意尽到诊疗义务和注意义务;建立充分告知制度,落实知情同意权;完善病案管理制度;合理检查及用药;建立医用产品的质量保证体系,协助患者维权等应对策略。Tort Responsibility law makes clear about medical damage responsibility that will exert a profound influence on diagnosis and treatment activities of medical institutes.This article elaborates the relationship between tort responsibility and related laws and regulations,which put forwards clauses of range of damage,identification properties and institute choice still needed further explicitness and perfection and their new changes,which put forward during medical practice should value on diagnosis and treatment obligation and attention obligation after tort responsibility law implement;it suggest that we need countermeasures,such as full informed system setting up,informed agreement implement,medical records management system perfection,reasonable examination and drug usage,quality insurance system of medical product setting up and assistant patient for safeguard rights.
