摘　　要：2010年新《中华人民共和国国家赔偿法》第35条明确规定了精神损害赔偿制度,在我国国家赔偿制度史上具有里程碑意义,也是国家在尊重和保护人权方面的进一步发展。但是,国家侵权精神损害赔偿在法律适用上仍需在识别要件、适用范围、适用原则和数额计算等方面进一步明确。The Article 35 has defined the system of infringement mental damages in the State Indemnity Law in PRC modified in 2010,which has landmark significance in the history of the system of infringement mental damages and further advancement in respect and protection of human rights.However,at the applicable law,the system of infringement mental damages should be further improved in some respect such as identification factors,scope and principles of application,amount calculation and so on.
