摘　　要：本文在总结当前矿业用地制度基本特征的基础上,分析了矿业用地退出机制及其问题,提出了矿业用地退出原则、退出路径和激励与约束机制。并指出通过复垦责任制度化和集约利用、及时变更等系列制度建设,提高制度绩效。Based on the basic characteristics of the current mining land use system,the authors analyze the exit system of the mining land and its problems,and put forward to countermeasures that involve proposed the exit principles of mining land,exit paths,mechanisms of incentive and restraint.In the end,the authors suggest that we shall be made efforts to improve the system performances of exit mechanisms of mining land through institutionalization of the reclamation responsibility,intensive use of land reclamation and making changes in time.
