摘　　要：专利维持年费机制的设置是专利制度从重点保护专利权人利益到保护专利权人利益和社会公众利益并重过渡的重要标志之一。该机制通过增加专利维持成本,影响专利维持时间,平衡专利权人和社会公众利益,促进技术创新,提高专利制度的运行绩效。The annual fee mechanism of patent maintenance is one of the important sign of the protect focus of patent system from only protect patentee＇ s interests to same timely protect the patentee＇ s interests and the public interests. This mechanism influences the patent maintenance time by increasing the patent maintenance cost and thus balances the patentee＇ s interests and the public interests, and promotes technology innovation and improves the patent system performance.
