摘　　要：传统医药是人类文明的历史结晶,也是现代医学的基础和中坚力量,它在现代医学不断向前发展的过程中起到了不可估量的作用。中国有丰富的传统医药知识,传统医药的智力成果属性决定了其适合于被纳入知识产权保护体系。但传统医药知识具有地域性、集体性、非新颖性等特征,自身属性特点又不同于现代知识产品,在现有知识产权制度下难以获得有效保护。我国急需制定有效的知识产权保护策略对传统医药进行保护,以免其继续流失和被不正当使用。Traditional medicine is the wisdom cream created by the human being as well as the foundation and backbone of modern medicine.It plays a great role in the process of modern medicine development.The resource of traditional medicine is rich in China.Traditional medicine is a kind of intellectual achievements,so it shall be protected by resorting to intellectual property law.Traditional medicine is regional、collective and not novel,these features are different from modern intellectual products,so it is difficult to be protected effectively by existing intellectual property law system.To prevent traditional medicine from draining and being used improperly,effective intellectual property protection strategy shall be made to protect traditional medicine as soon as possible.
