摘　　要：土地承包经营权可否继承,现有法律无明确规定,理论界和司法实务界存在争议。立足于规范解释,探求土地承包经营权基本属性,并结合社会实践来看,现有条件下土地承包经营权应不宜继承。There aren＇t well-defined rules about whether the land contractual management right can be inherited or not and there exists a dispute in theory and judicial practice. Based on the rule explanation, it explores the basic properties of land contractual management right. It shows that the right should not be permitted to inherit under these existing conditions.
