工业废水集中处理厂的法律地位研究——以环保部行政执法解释的检讨为中心

摘　　要：由于《水污染防治法》中并没有强行要求对工业废水进行集中处理,这使大量工业集中作业区的工业废水集中处理厂的法律地位不明。环保部通过行政执法解释将其界定为一般工业排污单位,这不仅使得工业废水集中处理厂在建设用地、资金筹集等方面面临诸多的困境,还直接导致其在运行过程中出现相关法律适用的难题。因此,应考虑在今后修订《水污染防治法》时,将工业集中作业区的工业废水实行集中处理。现阶段应通过地方水污染防治立法,鼓励工业集中作业区的工业废水实行集中处理,从工业废水集中处理厂价值与功能角度,将其定性为类似于城镇污水处理厂性质的市政公用基础设施。The legal status of industrial wastewater centralized treatment plants in industrial concentration districts is not clear because the Law on the Prevention and Control of Water Pollution does not forcibly require the industrial wastewater to be centralized treated.Defined as general pollutant discharge organizations by the environmental protection department,the wastewater centralized treatment plants in industrial concentration districts are faced with many difficulties in construction land claim and fund raising,which directly lead to legal problems in the operation.Therefore,we should consider centralized treatment of wastewater in industrial concentration districts when revising the Law.Presently the local water pollution prevention and control legislation should encourage the centralized treatment of wastewater in industrial concentration districts,defining the plants,similar to the urban sewage treatment plants according to their value and functions,as municipal public utilities.
