中国知识产权行政管理机构之设置与职能重构

摘　　要：我国知识产权行政管理机构在设置与职能上存在的问题较多,不利于加强知识产权管理与保护。依据知识产权行政管理机构设置的原则以及借鉴其他国家的先进经验,我国有必要对知识产权行政管理机构的设置与职能进行重构。设立统一的知识产权行政管理机构,将管理职能与执法职能相分离,以提供高质量的行政服务为基本理念,弱化乃至取消行政裁决职能,为我国知识产权事业发展提供制度保障。The disadvantages of China＇s IPR administrative setup and functions are many, not conducive to effective management and protection. Based on a number of basic principles for IPR administrative setup and successful experiences of other advanced countries, the paper argues that it is necessary to reform China ~s IPR administrative setup and to reorganize its functions. A comprehensive and uniform IPR administration is called for, which separates management and enforcement, enhances the rationale of high-quality services, weakens or eliminates administrative ruling functions in order to guarantee the development of IP in China.
