摘 要:随着私家车的普及,无偿搭乘交通事故不断增多。但引发交通事故后的责任划分和相关损害赔偿,我国法律至今没有明确的规定,从而导致司法审判无法可依,出现司法割据的局面。各地法院通过内部规定或参照民法相关规定来指导、解决个案或者类案。私家车无偿搭乘交通事故与一般的交通事故存在很大区别,过错责任原则应成为处理此类案件比较恰当的归责原则,双方均无过错,可适用公平责任,分担民事责任。With the popularization of private vehicles, traffic accidents involving free ride increase. However there are still no clear regulations in laws to define responsibilities after traffic accidents and compensation for the relevant damages, sequentially the situation is no rule to follow when judicial adjudications being put forward and judicial segmentation turning up. It is according to internal regulations or relevant regulations in civil law that courts throughout the country guide and solve individual cases or similar cases. Traffic accidents involving free ride in private vehicles are distinctively different from general traffic accidents, and principle of fault liability should be a relatively proper criterion of liability in handling this kind of cases. If the two sides are not guilty, the principle of justice can be applied, and the civil liability can be shared.
