公民获取政府电子文件信息的障碍因素分析

摘　　要：公民获取政府电子文件信息权利是今天电子文件时代公民所享有的重要的私权利,但这一权利要得到保障却存有不少的阻碍因素,其中制度的缺失,政府理性经济人本性及保密文化是阻碍公民这一重要私权利得以保障的最主要的三因素。法律制度的缺失使得这一权利未能上升为法定权利,救济制度、监督制度的缺失使得这一权利很难成为现实权利,而政府理性经济人本性及保密文化从根本上阻碍了这一权利得到有效的保障。Civil right of access to government electronic records is the important private right in modern society, but there are some obstacles to protecting the right. The lacking of regulations, the nature of government as rational economic man and the culture of secrecy are the most important obstacles. The right can not become legal right and realistic right because of the lacking of regulations and the nature of government as rational economic man as well as the culture of secrecy block the protection of the right radically.
