行政程序控权与传统控权模式的比较分析

摘　　要：随着"行政国家"现象的产生,政府开始大量干预国家的经济和社会事务,传统的实体控权模式逐渐显得力不从心。以程序控权为主的现代控权模式能够弥补传统控权模式的局限性,而且更适应现代社会事务管理的需要,其既有利于充分发挥行政权的积极作用,调动行政相对人参与行政行为的积极性,也有利于提高行政效率,避免事后监督造成的损失。As ＂the administrative state＂ phenomenon,the government began to intervene the national economic and social affairs,traditional power control mode has appeared to be inadequate.With the procedural right consisting mainly of modern power control mode can make up for the traditional control mode limitations,it adapts to modern social affairs management needs,it is conducive to give full play to the positive role of administrative power,it is conducive to fully mobilize the enthusiasm of the administrative relative participating in administrative behavior,it is also conducive to improve administrative efficiency,and try to avoid the afterwards supervise losses.
