摘　　要：当事人是否实质性地、充分而积极地参与诉讼程序,并与裁判者展开理性的对话,积极影响裁判结论,真正实现合法听审权是外国法院判决能否获得承认与执行的条件之一,程序参与、合法听审权以及程序主体性都和民事诉讼辩论主义原则的内容相吻合。我国民事诉讼程序应确立辩论主义,强化法官阐明职责,在制度上保障当事人的程序参与权以实现对外国法院判决的承认与执行。It is one of the standards to decide foreign judgment to be recognized and enforced whether or not the parties have reasonable dialogue with the judges and active influence on the judgment by participating judicial proceeding substantially fully and positively to realize the right to be heard before the court.Procedure participation,the right to be heard and procedural subjectivity,coincides with adversary system.It is necessary to establish adversary system and enforce the power to clarify and insure the procedural participation right of the parties and implement the recognition and enforcement of foreign judgment.
