摘　　要：缔约过失责任的范围对于缔约阶段的信赖投资水平具有重要影响。经济分析表明,没有责任会导致投资不足,严格责任会导致投资过度,以最佳信赖为限的严格责任规则符合经济效率的要求,却由于法院缺乏足够信息无法直接应用。在实践中,可能需要借助于可预见性规则、减损规则和期望利益等规则对缔约过失责任进行限制。The range of culpa has an important impact on the trust investment level in contracting phase.Economic analysis shows that no responsibility will lead to insufficient investment,strict liability will lead to excessive investment and strict liability with best trust limit is in line with the requirements of economic efficiency,but due to lack of sufficient informations,court can not be directly applied it.In practice,it needs the help of predictability rule,mitigation rule and expectation interest rule to limit the fault liability in contracting phase.
