摘　　要：民间法规则具有现代基础性决定了其在中国法治现代化建设中之地位和作用。民间法规则具有积极和消极的规制功能。民间法规则与国家法在形式和内容上的契合性决定了相互转化的可能性。The modem foundation of regulation of civil law decides its position and role in law modernization construction in China. Regulation of civil law has active and negative function of regulation. The correspondence in form and content of regulation of civil law and state law decides the possibility of transformation.
