摘  要:《国有土地上房屋征收与补偿条例》删除了非公共利益拆迁。于是,商业拆迁如果继续实施,必须得到双方全体一致的同意,本文谓之自然权利观的体现。但是,自然权利直接转化成法律条款有着其固有的条件,目前的任何一种拆迁都涉及到三方关系,具有特定的历史特点,不适用抽象的自然权利规则。拆迁问题是利益问题,不纯其为权利问题,交予权利解决,不仅没有看到问题的实质,而且会出现乱局,简单的问题复杂化。应该参照社会法学派的观点对现有的拆迁关系的主体之间进行利益衡量。政府必须直接面对被拆迁人,以具体的规定代替无边无际的协商。以最小的牺牲换来最大的利益,实现多赢的效果。State-owned Land Housing Levy and Compensation Ordinance(Opinion Soliciting Draft) removed nonpublic advantages removal.The implement of commercial removal must reach the agreement of both parties.This article considers that it is the reflection of view of natural rights.However,the conversion from natural rights to legal provisions is restrained by the inherent conditions.Recently,all removals concern relations among three parties,which has specific historical characteristics and is not applicable to abstract regulations of natural rights.Removals belong to interest problems,but not pure rights issue,improper solution will complicate simple problems. We should measure benefits between subjects with reference of view of sociological jurisprudence,which requires that the government faces the residents whose houses are relocated,replaces endless consultation by concrete regulations and gets the biggest benefits to reach the results of of multi-win.
