论体育赛事志愿者的法律关系及其立法启示

摘　　要：志愿者是现代体育赛事组织系统不可缺少的部分。他们不仅承担着为体育赛事服务的任务,还成为了传播本国精神文化、展示本民族风土人情的文化使者。体育赛事志愿者具有无偿性、自愿性和社会性的特点。基于此,体育赛事志愿者与相关主体的法律关系应是一种基于自愿协商达成的契约关系,按照约定内容承担法律责任。从体育赛事志愿者中的法律经验中得到以下启示:我国的体育赛事志愿活动应加强立法工作,明确立法的目的,明确体育赛事志愿者和相关主体的权利、义务关系,明确体育赛事志愿者和相关主体的法律责任及相关救济方式。Volunteers are an indispensable part of the modern sports event system. Not only do they bear the task of service for the sports events, but also spread to the spirit of national culture, display their own cultural customs envoy. The volunteers are with unpaid, voluntary and social characteristics. Therefore, the legal relationship of volunteer and relevant body should be negotiated voluntary contractual, in accord- ance with the terms stipulated liability. The following inspirations are drawn from the legal experience of sports events volunteer service. The volunteer activities of sports events should strengthen legislation in China, that is, make clear legislative intent, rights and obligations, liability and related remedies between sports events volunteer and relevant body.
