摘　　要：突发事件应对法是针对突发公共安全事件的立法,该法中政府行政管理成分居多,对突发公共安全事件进行民商事调整的法律规定较少,使我国现行法律对突发公共安全事件所引起的法律问题的民商法调整显得力不从心。针对突发公共安全事件调整中存在的民事法律问题进行研究,分析我国民事法律制度存在的缺陷,并据此提出完善立法的几点建议。Emergencies law is the legislation on emergent events of public safety, in which the proportion of public administration of the government is greater, while the stipulations on civil and commercial adjustments of emergencies of public safety are less. It leads to the inability to achieve the goal of the civil and commercial adjustments on the legal issues caused by emergencies of public safety in China according to the present law. The civil legal issues of the adjustment of emergencies of public safety are researched, the lacks of civil code institution in China are analyzed, and some suggestions are proposed accordingly on the perfection of the legislation of emergencies law.
